TERMS OF SERVICE

PREAMBLE

This Terms of Service Agreement (this “Agreement”) is entered into by and between us and you, and is made effective as of the date of your use of this website ("Site") and/or the date of electronic acceptance. This Agreement sets forth the general terms and conditions of your use of the Site (TrusteeRepair.com) and/or SERVICES purchased or accessed through this Site (individually and/or collectively, the “Service(s)”). 

The terms “we”, “us” or “our” shall refer to 1213868 B.C. LTD. and/or it’s agent(s)/representative(s) who are duly authorized to provide Service(s) under the Service Mark "TrusteeRepair.com". The terms “you”, “your”, and/or “customer” shall refer to any individual and/or entity who accepts this Agreement, binding themselves or their Principal to terms of the Site and/or Service(s).

IF YOU DO NOT AGREE TO ANY PART OF THESE TERMS, YOU MUST CEASE USING THIS SITE. AND SHALL NOT REQUEST ANY SERVICE DESCRIBED HEREIN.

DEFINITIONS 

Appliance (or Appliances) - means, a washing machine, dyer, dishwasher, range/stove, oven, refrigerator, air conditioner, vacuum system, microwave, and/or such other device, whether residential or commercial in its intended use.
Service (or Services) - means diagnosing and/or performing a repair of a malfunctioning Appliance.
repair - when a technician identifies the source of a malfunction and then provides the chain of custody for the part required to rectify such.
part - any item replaced on and/or added to property for the purpose of completing a repair.
reported malfunction -  means the malfunction described by you in your request for Service that identifies the symptoms that lead you to believe your Appliance requires repair.
call out - an onsite visit to begin Service(s) of diagnosis and/or repair of one or more Appliances where, upon completion of such, the customer agrees to be liable for the resulting bill.
call out fee - the minimum charge for responding to a request for Service of one Appliance at a unique address in Vanderhoof, Fraser Lake, and/or Fort St. James is $159.00 + GST.

MODIFICATION OF AGREEMENT, SITE, AND/OR SERVICES

We may, in our sole and absolute discretion, change or modify this Agreement, and/or any policies or agreements which are incorporated herein, at any time, and such changes or modifications shall be effective immediately upon posting to this Site. Your use of this Site and/or the Services after such changes or modifications have been made shall constitute your acceptance of this Agreement as last revised. If you do not agree to be bound by this Agreement, do not use (or continue to use) this Site or the Services. WE RESERVE THE RIGHT TO MODIFY, CHANGE, OR DISCONTINUE ANY ASPECT OF THIS SITE AND/OR THE SERVICES, INCLUDING WITHOUT LIMITATION PRICES AND/OR FEES FOR THE SAME, AT ANY TIME.

ELIGIBILITY; AUTHORITY

This Site and/or the Services are available only to individuals (“Customers”) who may legally become party(s) to a contract. By using this Site and/or the Services, you represent and warrant that you are (i) at least eighteen (18) years of age, (ii) and/or otherwise recognized as being able to form legally binding contracts under applicable law.

If you are entering into this Agreement on behalf of a corporation and/or other entity/organization, you represent that you have the legal authority to bind your Principal to the terms and conditions contained in this Agreement, in which case the terms "you", "your", "User" or "customer" shall refer to such entity. If, after your electronic acceptance of this Agreement, if we find that the perceived Agent does not have the actual legal authority to bind such entity/organization, the actor shall be personally responsible for the obligations created by requesting Services . We shall not be liable for any loss or damage resulting from our reliance on any instruction, notice, document or communication reasonably believed by us to be genuine and originating from an authorized representative of you and/or your organization. If there is doubt about the authenticity of any such instruction, notice, document or communication, we reserve the right (but are under no duty) to request additional authorization and/or clarification from you.

OUR PROMISE TO YOU

We offer to investigate the condition of your Appliance(s), including the reason(s) for its reported malfunction(s), and/or to provide an estimate to repair such Appliance(s), if possible, whenever you accept the terms of Service and/or request a call out and/or direct us to take any action on your behalf.

In the event that we cannot determine the reason for the reported malfunction and/or we suspect/confirm that more than one component within the appliance is faulty, we may provide an informal estimate and/or recommend any Appliance(s) that may be beyond economical repair, be replaced by you.

Nothing in this Agreement requires us to provide any Service(s) to any person(s) for any reason(s) and such refusal is at our sole discretion. Where any duty, not agreed to expressly by us, is imposed by you for the purpose of making a contract with us, we reserve all rights to charge an appropriate fee(s) to cover our costs, should we conditionally accept your offer.


INTERIM CONSIDERATIONS FOR PUBLIC HEALTH HAZARDS & PREVENTION OF DISEASE

The Service(s) described herein and/or provided by us are deemed essential by the governing body responsible for Public "Health". It is our commitment to preserve the health and well being of our agents/representatives/technicians as well as the confidence of our customers while preventing disease and/or other health hazards. Until such time that Public "Health" has canceled emergency declarations and/or orders for the "SARS-COV-2 pandemic", the parties herein agree to maintain "social distancing" of approximately 6 feet wherever possible, and where such is not possible, masks will not be worn by our agent(s)/representative(s)/technician(s) under any circumstance without a service fee set by such agent(s)/representative(s)/technician(s) and delivered to you. You undertake that; the area where Service(s) is to be conducted shall be clear of obstacles and/or other bodies so that the agent(s)/representative(s)/technician(s) may safely and effectively provide Service.

Additionally: We believe, The Public Health Act [SBC 2008] Chapter 28 ("PHA") section 15 and section 16(1) (f) describes prohibitions for preventing disease(s) and/or other health hazards, such may include, but are not limited to, Bacterial Pneumonia. We believe that the "clothing" and/or "personal protective equipment" which may include, but is not limited to, face coverings risks trapping dangerous bacteria(s) that could contribute to a disease and/or health hazard.

Our agents are not authorized to answer questions regarding vaccination and/or status. Our call out fee will be charged if our agent(s) arrive(s) and do not enter the premises at your express and/or implied request.

Where you may require that we comply with any procedures and or guidelines set out by you, we waive no rights under our terms of service for any reason at any time, and any implied and/or expressed act otherwise by us, for your benefit does not constitute any wavier of our rights.
